This website is operated by elSage Designs LLC ("elSage," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of this website and the custom design and printing services offered through it. By visiting this site or engaging our services, you agree to be bound by these Terms.

Section 1: Use of This Site

You agree to use this website and our services only for lawful purposes and in a manner consistent with these Terms. Any breach of these Terms may result in suspension or termination of your access to our services.

Section 2: General Conditions

We reserve the right to decline service at our discretion, including in situations involving abusive conduct, fraudulent activity, or requests that fall outside the scope of services we offer.

Information submitted through this site may be transmitted electronically across networks in connection with standard web and payment processing. Payment information is encrypted in accordance with industry standards.

The content, materials, and design work made available through this site and our services may not be copied, reproduced, or redistributed without our express written permission.

Section 3: Accuracy of Site Content

The information on this site is provided for general reference. We make reasonable efforts to keep it accurate and current, and we reserve the right to update site content at any time.

Section 4: Quotes, Pricing, and Custom Orders

All quotes provided for custom design and print services are valid for 30 days from the date issued, unless otherwise specified in writing. We are happy to extend or revisit a quote upon request.

Once a deposit or payment has been made toward a project, we are committed to completing the contracted work in accordance with the agreed scope, timeline, and terms outlined in your project agreement. Payment secures your place in our production schedule and reflects our shared commitment to seeing the project through.

Pricing for products and services may be adjusted for future quotes or orders, but pricing for work already contracted and paid for shall not be subject to change.

Section 5: Products and Custom Design Services

Custom orders are governed by these Terms together with the individual project agreement for that order, which will outline specifics such as scope, proofing, and production timeline.

We make every reasonable effort to display product colors and design proofs accurately.

Section 6: Order Acceptance and Cancellation

We review and accept orders in good faith and are committed to fulfilling the work we take on. In the rare circumstance that we are unable to move forward with an order, including matters involving suspected fraud, abuse, or circumstances outside our reasonable control, we reserve the right to cancel the order.

We ask that all account and contact information provided at checkout be current and accurate, so that we are able to communicate with you effectively throughout your project.

Section 7: Third-Party Links

This site may contain links to third-party websites that are not affiliated with elSage. We encourage you to review the policies of any third-party site independently, as we are not responsible for their content or practices.

Section 8: Intellectual Property and Design Ownership

8.1: Designs Created by elSage. Unless otherwise specified in a signed project agreement, elSage Designs LLC retains ownership of the artwork, designs, and creative work we create, including original designs and adaptations of our existing artwork. Clients are granted usage rights to their commissioned design as set forth in their individual project agreement. These Terms alone do not transfer ownership or grant exclusivity; the scope of usage and any exclusivity are defined by the signed agreement for that project.

8.2: Client-Supplied Artwork. When a client provides their own artwork, logo, or design files for print production, elSage claims no ownership of that material. By submitting artwork for production, you represent that you hold the necessary rights to that artwork and authorize us to reproduce it for the purposes of your order.

8.3: Concepts Developed During the Design Process. As part of our creative process, we frequently develop multiple design concepts before a client selects a final direction. The client's commissioned rights extend to the concept selected and produced for their project. Alternative concepts developed but not selected remain the property of elSage and may be retained, adapted, or used in future projects, including for other clients.

8.4: Feedback. Suggestions or feedback you share with us about our site or services, separate from artwork submitted for a commissioned project, may be used by us without obligation or compensation.

Section 9: Prohibited Uses

You agree not to use this site or our services to violate any applicable law, infringe on the intellectual property rights of others, harass or discriminate against any individual or group, or interfere with the security or proper functioning of this website.

Section 10: Limitation of Liability

To the fullest extent permitted by law, elSage Designs LLC shall not be liable for indirect, incidental, or consequential damages arising from the use of this site or our services. Our total liability in connection with any order shall not exceed the amount paid by the client for that order.

Section 11: Indemnification

You agree to indemnify and hold elSage Designs LLC harmless from any third-party claim arising out of your breach of these Terms, your violation of applicable law, or your submission of artwork for which you do not hold the necessary rights.

Section 12: Severability

If any provision of these Terms is found to be unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Section 13: Termination

These Terms remain in effect for the duration of your use of this site and our services. Obligations that by their nature should survive termination, including payment obligations for completed work and intellectual property rights, shall continue to apply.

Section 14: Entire Agreement

These Terms, together with any project agreement and policies referenced herein, constitute the entire understanding between you and elSage Designs LLC with respect to the subject matter herein, and supersede any prior agreements or communications on the same subject.

Section 15: Governing Law

These Terms are governed by the laws of the State of Washington. Any dispute arising under these Terms shall be subject to the jurisdiction of the courts of Skagit County, Washington.

Section 16: Changes to These Terms

We may update these Terms from time to time by posting changes to this page. Continued use of this site following any update constitutes acceptance of the revised Terms.
